Parties and definitions
The following booking conditions apply to all ‘Regional Tours’ booked through SmartMovesFrance or SmartMovesFrance.com (us/we) and form the basis of the contract between us and all the persons (you/your) included in the booking. Regional Tours are those tours that comprise a combination of components made under one booking.
Booking and Payments
Choosing you tour duration. Once you have looked through the website and explored your options we would be happy to discuss your requirements and assist you in any way we can. You can call us on the numbers shown on the ‘How to Book’ and ‘Contact Us’ pages on our website or you can e-mail us at info@smartmovesfrance.com
You can book either on the phone or through the website.
Booking: In order to make a booking you must first call us to confirm date availability in order for you to book your flights with whichever carrier you choose. We cannot be held responsible for any changes, delays, re-routing or cancellations of flights by the carrier. Once confirmation has been verified by our office a 25% non-refundable deposit must be paid using the methods of payment as detailed on the site (By cheque or through PayPal) Once payment has been received or confirmed we will issue a booking confirmation, a copy of which should be signed and returned to our offices at Cadelech, 24500 SAINT AUBIN DE CADELECH, France.
Payment: All payments should be made to N J Ward. Full payment is required 8 weeks before departure or at the time of booking if within 8 weeks of departure. If the balance of payment is not received by the due date we reserve the right to treat your booking as cancelled and therefore subject to a cancellation charge of 75% in accordance with our cancellation charges as detailed in these conditions.
Changes to a Booking
Once a booking has been confirmed and a deposit paid it is possible to transfer your booking to an alternative date providing you inform us within 8 weeks of departure. There is no charge made for changing dates. All conditions apply to the new booking.
Cancellation
Any cancellation by you must be made in writing to us by the lead person responsible for the booking. Cancellations received after the date of issue of the confirmation invoice will be subject to the cancellation charges shown in the table below. The date on which written confirmation is received by us will determine the level of cancellation charges applicable. The cancellation charges are expressed as a percentage of the total tour price.

If, for whatever reason, we have to cancel your tour after the confirmation invoice has been issued we would offer you an alternative date or a full and prompt refund.
In the unlikely event of a change of date we would notify you at least 28 days before you are due to travel.
Pricing
We reserve the right to alter or adjust our prices at any time prior to accepting a booking. Once a booking has been accepted, a confirmation Invoice issued and full payment has been received, the price is then guaranteed not change unless the itinerary is altered at your request in which case a new invoice would be raised superceding the original invoice.
Insurance
It is a condition of booking that all travellers are covered by adequate travel insurance to include liability, medical and cancellation insurance running from the date of confirmation. Always ensure that you have all relevant documents relating to your travel insurance with you whilst on the tour as we may need to refer to this in the event of an accident.
Passports
You and your fellow travellers must be in possession of a valid Passport at the time of travel. Recent legislation requires that passports are valid for 6 months after your return date. Immigration officials may prohibit access if this rule is not observed. You must also ensure that the name on the passport corresponds with the name on your flight ticket/confirmation. SmartMovesFrance cannot be held responsible for any failure on your part to comply with relevant passport requirements.
Health
It is your responsibility to take medical advice from your doctor or practitioner as to whether or not you are fit to travel and any details regarding mandatory vaccinations and prophylaxis required when travelling to foreign countries. SmartMovesFrance will not be held responsible for any failure to obtain or comply with relevant health standards.
Matters beyond our control
We cannot accept responsibility for problems caused by force majeur. This means unusual and unforeseeable circumstances beyond our control including, but not limited to; acts of war, threat of war, political disputes, riots, terrorist activity, (actual or threatened) border closures, industrial action, technical problems with machinery, transport or equipment, government intervention, natural disasters, fire or explosion, inclement weather and acts of God.
Website accuracy
Every effort has been taken to ensure that the descriptions, facts or opinions on our website are accurate on an ongoing basis. Photographs only relate to a specific item when captioned. The layout and furnishing of rooms shown in any photographs whether on our site or on a linked site of one of our suppliers, may change. We will endeavour to inform you of any changes that come to light at the time of booking, or if already booked, prior to departure. We cannot accept responsibility for any descriptions, facts or opinions published by any third party.
Authority and flexibility
At all times the reasonable decision of the tour guide, accommodation owners or company representatives will be final on all matters likely to endanger the safety and well being of yourselves or others. You must at all times strictly comply with the laws, customs, foreign exchange and drug regulations of the country visited. Should you fail to do so then your tour arrangements may be terminated without recourse to any refund and without any legal claim against SmartMovesFrance. All itineraries are subject to change and these changes are solely at the discretion of the Tour Guide on the day. It is understood that that the route schedules, itineraries, amenities and mode of transport may be subject to alteration without prior notice due to local circumstances or events which may include sickness, mechanical breakdown, flight cancellations, strikes, events emanating from political disputes, entry or border disputes, climate and other unpredictable or unforeseeable circumstances.
Claims and complaints
In the event that you have cause for complaint whilst on your tour you must bring it to the attention of your Tour Guide at the earliest opportunity. You must afford us a fair and reasonable opportunity to correct the matter during the tour. If you fail to do so you deprive us and our suppliers the chance to investigate your complaint and to do our best to rectify it. If we are unable to resolve matters whilst you are on the tour and you remain dissatisfied you must write to us within 28 days of your return with full details.
Late arrivals
We cannot accept responsibility if you miss your flight aircraft due to late check in or delays in connecting transport booked by you.
Accommodation
The accommodation provided by us is solely for the use of those persons named on the confirmation invoice and subletting, sharing or assignment is prohibited. Any damage or breakages at the accommodation which are your responsibility must be paid for before you vacate the accommodation
Law and jurisdiction
The contract between us and any matters arising from it will be governed by English Law and are subject to the jurisdiction of the courts of England and Wales.
